Terms & Conditions

These Terms & Conditions (“Terms”) govern all use of the websites, online store, training registration portals, digital content, and any related services operated by Viking Dives LLC (“Viking Dives,” “we,” “us,” or “our”). By accessing or purchasing from vikingdives.com or by engaging our training or equipment-service offerings, you agree to be bound by these Terms. If you do not accept every part of them, do not use our Site or Services.

1. Definitions

  • “Site” – all webpages under the domain vikingdives.com and any sub-domains.
  • “Services” – e-commerce sales, diving instruction, travel, equipment servicing, or any other offering we provide.
  • “Products” – physical goods sold on the Site or in-store, including new, used, demo, or rental equipment.

2. Eligibility & User Obligations

You must be 18 years or older (or have verifiable parental consent) and legally able to form binding contracts. You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information at checkout or registration.

3. Changes to These Terms

We may update these Terms at any time. Material revisions become effective 14 days after posting; minor editorial changes are effective immediately. Continued use after an update constitutes acceptance of the new Terms.

4. Orders, Pricing & Payment

  • Prices are shown in U.S. dollars and are subject to change without notice.
  • Placing an item in your cart does not reserve it; we accept an order only when we email a shipping confirmation.
  • We may refuse or cancel any order in whole or in part (e.g., for suspected fraud or stock errors).
  • Sales tax is charged where required by law.
  • Payment is captured at shipment unless otherwise noted (e.g., training deposits).

5. Shipping, Delivery & Risk of Loss

Title and risk of loss transfer to you when we hand the package to the carrier. Transit times are estimates only. International customers are responsible for duties, taxes, and import-related fees in their jurisdiction.

6. Returns & Refunds

Our separate Returns & Refunds Policy forms part of these Terms. In brief:

  • 30-day window, new/unused condition.
  • You pay return shipping; we charge no restocking fees.
  • Upon inspection you may choose a replacement or full refund.

7. Training & Safety Disclaimer

Scuba diving, freediving, technical diving, and related activities involve inherent risks that can result in serious injury or death. You acknowledge that participation requires proper training, medical fitness, and adherence to all safety protocols. Viking Dives makes no guarantee of your personal safety or performance. You assume full responsibility for evaluating your own abilities and for using Products in accordance with manufacturer instructions, training agency standards, and local regulations.

8. Warranty & Service

New Products may carry a manufacturer’s warranty; used/demo items are sold “as-is” unless stated otherwise. For equipment you submit for service, we will exercise reasonable care but are not liable for loss or damage beyond the cost of the service performed.

9. Abandoned Equipment

If purchased, serviced or stored equipment is not collected within 90 days after we notify you—by email, phone, or text—that work is complete or that the item is available for pickup, the item will be deemed abandoned. You agree that Viking Dives may, at its sole discretion, destroy, resell, donate, or otherwise dispose of abandoned equipment without further notice or liability. Any proceeds of resale will first cover outstanding service, storage, and administrative fees; remaining funds (if any) will be forfeited.

9. Intellectual Property

All content on the Site—including text, graphics, logos, videos, and course materials—is our property or licensed to us and protected by U.S. and international IP laws. No element may be copied, republished, or exploited without prior written consent.

10. User-Generated Content

If you post reviews, photos, or other content, you grant us a non-exclusive, perpetual, worldwide license to use, display, reproduce, or modify that content in any medium. You represent that you own or control all rights to what you post.

11. Third-Party Links

Our Site may link to external sites for convenience. We do not endorse and are not responsible for the content or practices of those sites.

12. Limitation of Liability

To the fullest extent permitted by law, Viking Dives is not liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, personal injury, or property damage) arising from your use of the Site, Services, or Products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid us for the specific Product or Service at issue.

13. Indemnification

You agree to defend, indemnify, and hold harmless Viking Dives, its owners, employees, and instructors from any claims, damages, or expenses (including attorney fees) arising out of your breach of these Terms or misuse of the Site, Services, or Products.

14. Governing Law & Venue

These Terms are governed by the laws of the State of New Mexico, U.S.A., without regard to its conflict-of-law principles. You agree to submit to the personal and exclusive jurisdiction of the state or federal courts located in Bernalillo County, New Mexico for any dispute that is not subject to informal resolution.

15. Severability & Waiver

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not constitute a waiver of that right.

16. Entire Agreement

These Terms (including referenced policies) are the entire agreement between you and Viking Dives regarding the Site and Services and supersede all prior understandings.
